By pushing customers to buy branded medications as opposed to readily available generic options, CVS® could rake in higher rebates from drug companies, some of which were sent as clawbacks to CVS Health® subsidiaries.

Which customers were hurt the worst?
The fraudulent scheme is believed to have disproportionately affected elderly patients with end-stage renal failure.
Plus, many beneficiaries of the SilverScript® Part D program went without critical treatment because they were unable to access generic versions of necessary drugs at affordable costs.
The company felt that SilverScripts® Part D customers were less likely to complain about the potential costs because many receive subsidies to cover their medication expenses.
But patients covered by private health insurance were also allegedly subject to the CVS-drug manufacturer scheme.
